Post-event report
On 27 February 2026, Inside the SIAC Rules: Perspectives from Brazil and Singapore was held in São Paulo at the CAM‑CCBC Auditorium, as part of the official programme of the Pre‑Moot São Paulo 2026. The event was jointly organised by Young ICCA, YSIAC and CAM‑CCBC, bringing together practitioners from Brazil and Singapore to discuss practical and contemporary issues arising under the SIAC Arbitration Rules.
The session was moderated by Ana Flávia Furtado (CAM‑CCBC) and opened with remarks by Adriana Uson (SIAC), who provided an institutional perspective on recent developments and the increasing relevance of the SIAC Rules in international arbitration.
Key Discussion Highlights
The panel was structured around four thematic discussion blocks, each focusing on provisions of the SIAC Rules that frequently arise in practice and in moot court settings.
1. Determination of the Applicable Rules
The first discussion addressed how arbitral tribunals determine the applicable version of institutional rules, particularly in light of the similar temporal application provisions in the 2016 and 2025 SIAC Rules. The debate focused on whether this determination should be treated primarily as an issue of contract interpretation and on the role of party agreement in resolving potential procedural consequences. Comparative references were made to arbitral and judicial approaches to this issue.
2. Arb‑Med‑Arb Protocol and Promotion of Mediation
The panel then examined the SIAC/SIMC Arb‑Med‑Arb (AMA) Protocol, discussing how it differs from traditional med‑arb mechanisms and how it fits within current regulatory and enforcement frameworks. Particular attention was given to the enhanced promotion of mediation under the 2025 SIAC Rules and to how these developments interact with Brazilian arbitration and mediation practice.
3. Early Dismissal and Expedited Proceedings
Another key segment focused on the early dismissal mechanism under the SIAC Rules and its operation in practice. Panelists discussed efficiency gains and potential due process considerations, as well as the introduction of streamlined and expedited procedures under the 2025 Rules, exploring how these mechanisms seek to balance procedural efficiency with the parties’ right to be heard.
4. Third‑Party Funding
The final discussion addressed third‑party funding, with reference to Section 38 of the SIAC Rules. The panel considered the objectives of the SIAC’s regulatory approach and discussed the discretionary powers granted to arbitral tribunals to order disclosure of funding arrangements, including the safeguards and precautions relevant to exercising such powers.
Concluding Remarks
The event fostered an open and interactive exchange between panelists and participants, combining institutional, comparative and practice‑oriented perspectives. It provided valuable insights for practitioners, academics and students preparing for the Vis Moot, while also contributing to broader discussions on efficiency, procedural fairness and innovation in international arbitration under the SIAC framework.
